NFT Terms & Conditions

The PELECANs, PLVRS2.0, and PELEverse Character Collections are sets of digital assets (non-fungible tokens, or NFTs) offered by PELE Network, Ltd. and represented by their respective smart contracts on the Zilliqa blockchain. Ownership of these digital assets (hereafter "NFTs") is governed solely by the smart contracts running on the Zilliqa network. This website and all connected services are provided as is, and with no warranties of any kind. By using this website, you accept sole responsibility for any transactions involving the NFTs, and you agree wholly to these Terms and Conditions ("Terms").

Transferability

Until the PLVRS.online marketplace has been completed, you must use a third-party service using the Zilliqa blockchain to transfer your NFTs, such as Okimoto DEX or SpardaWallet.

Resale

PELE Network, Ltd. makes no guarantee of secondary market price or rarity.

Refund Policy

When you make a purchase through PELE, you have immediate access to, and use of, the PELE Token you have purchased. Accordingly, except as detailed in these Terms of Sale, to the extent permitted by applicable law, cancellations are not permitted after a purchase, and we do not offer any refunds or credits. PELE reserves the right to modify this refund policy as set forth below at any time. We may offer refunds or compensation, but doing so does not imply that PELE is liable nor at fault for any reason.

Art

Depending on the smart contract and the terms of distributing its NFTs, the actual NFT minted to buyer7s wallet may be random, preview art is indicative only - in this case, user should only purchase if they like the collection as a theme rather than any particular NFT.

No Guarantee of Future Development

While we are working very hard to make it so, PELE Network, Ltd. makes no guarantee on any future work or development for its NFTs, including cross-chain support.

Ownership

Ownership of the NFTs is governed solely by the Zilliqa blockchain and the smart contracts deployed thereon. As a decentralized blockchain, there is no ability to undo, reverse, or restore any transactions made. You accept sole responsibility for any transactions made which involve your NFTs.

Personal Use

As long as you continue to comply with these Terms, PELE Network, Ltd. grants you a worldwide, royalty-free license to use, copy, and display the purchased NFT(s), along with any extensions or derivatives that you choose to create or use, solely for the following purposes: (i) for your own personal, non-commercial use; (ii) as part of a marketplace that permits the purchase and sale of your NFT, provided that the marketplace cryptographically verifies each NFT owner’s rights to display their NFT to ensure that only the actual owner can display the NFT; or (iii) as part of a third party website or application that permits the involvement or usage of your NFT, provided that the website/application cryptographically verifies each NFT owner’s rights to display their NFT to prevent non-owners from displaying illicit copies of the NFT, and provided that the NFT is no longer being used on the site once the owner of the NFT leaves the website/application.

Commercial Use

As long as you continue to comply with these Terms, PELE Network, Ltd. grants you an unlimited, worldwide license to use, copy, and display the purchased NFT for the purpose of creating derivative works based upon the NFT (“Commercial Use”). Examples of such Commercial Use would be producing printed copies of the NFT on merchandise products (T-Shirts etc.). Nothing in this Section will be deemed to restrict you from (i) owning or operating a marketplace that permits the use and sale of NFTs generally, provided that the marketplace cryptographically verifies each NFT owner’s rights to display their NFT to prevent non-owners from displaying illicit copies of the NFT; (ii) owning or operating a third-party website or application that permits the inclusion, involvement, or participation of NFTs generally, provided that the third party website or application cryptographically verifies each NFT owner’s rights to display their NFT to prevent non-owners from displaying illicit copies of the NFT, and provided that the NFT is no longer being used on the site once the owner of the NFT leaves; or (iii) earning revenue from any of the commercial uses mentioned herein.

Assumption of Risk

Value and Volatility. The prices of blockchain assets may be extremely volatile and subjective and blockchain assets have no inherent or intrinsic value. Fluctuations in the price of other digital assets could materially and adversely affect the value of the PELE oken, which may also be subject to significant price volatility. Each PELE Token has no inherent or intrinsic value. We cannot guarantee that any PELE token purchased will retain their original value or any value at all, as its value is inherently subjective and factors occurring outside of the PELE ecosystem may materially impact the value and desirability of any particular PELE token. The User acknowledges and agrees that the token may lose all its value.

Tax Calculations. You are solely responsible for determining what, if any, taxes apply to your PELE token-related transactions. We are not responsible for determining the taxes that apply to your transactions on PELE, and will not provide such information to Users.

Inherent Risks with Internet Currency. There are risks associated with using an Internet-based currency, including, but not limited to, the risk of hardware, software and Internet connections, the risk of malicious software introduction, and the risk that third parties may obtain unauthorized access to information stored within your electronic wallet. You accept and acknowledge that we will not be responsible for any communication failures, disruptions, errors, distortions or delays you may experience when using the Zilliqa Network, however caused.

Regulatory Uncertainty. The regulatory regime governing blockchain technologies, cryptocurrencies and tokens is uncertain, and new regulations or policies, whether on a Federal level or otherwise, may materially adversely affect the development of the PELE ecosystem, and therefore the potential utility or value of your tokens.

Software Risks. Upgrades to the Zilliqa Network, a hard fork in the Zilliqa Network, or a change in how transactions are confirmed on the Zilliqa Network may have unintended, adverse effects on all blockchains using the Zilliqa Network’s smart contract standard, including the PELE ecosystem.

Severability

In the event any provision or part of these Terms is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Terms, will be inoperative.
